By entering this giveaway, you agree to comply with and be bound by the following terms and conditions. Please read these terms carefully before entering the giveaway.

Eligibility

  1.  The giveaway is open to all individuals who are:

    1. Residents of Australia;

    2. Aged 18 years or older at the time of entry;

    3. Not employees, contractors, or agents of the Promoter, or members of their immediate families (spouse, parent, child, sibling) or households.

  2.  The giveaway is void where prohibited or restricted by law.

Giveaway Period

  1. The giveaway commences on 24 January 2025 at 5PM (AEDT) and ends on 30 January at 12PM (AEDT) (Giveaway period).

  2. Any entries received after the closing date will not be eligible for the giveaway.

How to Enter

  1. To enter the giveaway, participants must complete the following steps on the post published on the @jancedistillery Instagram page at 24 January 2025, 5PM AEDT.

    1. Tag a friend in the comments of the post.

    2. Both accounts must follow @jancedistillery on Instagram

    3. Share the giveaway post to their Instagram stories with a public account.

  1. Entries are limited to one per person, unless otherwise stated.

  2. Entries that are incomplete, illegible, or incorrect may be disqualified at the sole discretion of the Promoter.

  3. No purchase is necessary to enter the giveaway.

Prize(s)

  1. There will be two winners of the prize.

  2. The winners will receive:

    • TWO (2) bottles of Jance Double Oak (valued at RRP $130)
    • ONE (1) Jance-branded bottle bag (valued at RRP $2)

  1. The prize is not transferable, exchangeable, or redeemable for cash.

  2. If the prize is unavailable or cannot be provided for any reason, the Promoter reserves the right to substitute the prize with another prize of equal or greater value.

Winner Selection

  1. The winner(s) will be selected at random by random draw on January 30, 2025.

  2. The winner will be notified via electronic mail or social media direct message within 48 hours of the draw.

  3. If the winner does not respond to the notification within 72 hours or is otherwise ineligible, the Promoter may, at its sole discretion, select an alternative winner.

Redemption of Prizes

  1. The prizes will be sent to the winners confirmed by the steps in items 15 to 27.

  2. The Promoter may require a winner to provide identification as required by the Promoter including (without limitation) proof of identity, proof of age and proof of residency (to the Promoter’s satisfaction and at its sole discretion) in order to confirm the contestant’s age, identity, address, and eligibility to enter the competition.

Disqualification

  1. The Promoter reserves the right to verify, reject or disqualify any entries into the Competition, including the period in which a winner has been determined and notified, and including circumstances in which:

    • The winner fails or refuse to take part in any element of the Competition;
    • The winner fails to provide identification as required by the Promoter;
    • The winner provided incorrect, false, or misleading information;
    • The entry does not comply with any of these terms and conditions; or
    • The entry is submitted by any person who tampers with or benefits from tampering with the entry process, the operation of the Competition or whose acts breaches these terms and conditions.

Publicity

  1. By entering the giveaway, the winner agrees to allow the Promoter to use their name, image, and entry for promotional purposes, without further compensation, unless prohibited by law.

Privacy

  1. By entering the giveaway, you agree to the collection and use of your personal information by the Promoter for the purpose of administering the giveaway, notifying the winner, and as otherwise described in these Terms and Conditions.

  2. All personal information will be handled in accordance with the Promoter's privacy policy, which can be found at https://jance.com.au/pages/terms-and-conditions.

  3. Participants may request access to, or correction of, their personal information by contacting the Promoter at info@jance.com.au.

General Terms

  1. The Promoter reserves the right to cancel or suspend the giveaway at any time, including if any technical issues, fraud, or other circumstances beyond the Promoter’s control compromise the fairness or integrity of the giveaway.

  2. The Promoter’s decision is final in all matters relating to the giveaway, including the selection of winners and the interpretation of these Terms and Conditions.

  3. By entering the giveaway, participants agree to release and hold harmless the Promoter and its affiliates from any and all claims, liability, or damages arising out of the giveaway or the prize.

  4. These Terms and Conditions are governed by the laws of New South Wales, Australia, and any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

Limitation of Liability

  1. To the maximum extent permitted by law, the Promoter is not responsible for any loss, injury, or damage of any kind, whether direct or indirect, arising from the giveaway, including but not limited to:

    • Technical malfunctions or failure of electronic equipment or networks;
    • Incorrect or inaccurate entry information;
    • Any injury or damage to persons or property related to or resulting from participation in the giveaway or use of the prize.

Force Majeure

  1. The Promoter shall not be liable for any failure to perform its obligations under these Terms and Conditions due to events beyond its reasonable control, including but not limited to acts of God, government action, natural disasters, or technical failures.

Changes to Terms and Conditions

  1. The Promoter reserves the right to amend, modify, or supplement these Terms and Conditions at any time during the giveaway period, provided that such changes do not adversely affect the rights of entrants.

Compliance with Laws

  1. The Promoter will ensure that the giveaway is compliant with the laws and regulations of New South Wales, Australia, including the Lotteries and Art Unions Act 1901 (NSW) and the Australian Consumer Law (Competition and Consumer Act 2010).

  2. The Promoter will adhere to all applicable requirements of the NSW Office of Fair Trading and any other relevant regulatory bodies regarding the operation of the giveaway.

Governing Law and Disputes

  1. These Terms and Conditions are governed by the laws of New South Wales, Australia.

  2. Any disputes regarding this giveaway shall be resolved in the courts of New South Wales, Australia.
